The following terms and conditions of use (“Terms”) govern the relationship between you and First Capital Real Estate Investment Trust and its affiliates (“First Capital”; “we”, “us” or “our”) with regard to information you provide First Capital for the purposes of the [Small Business Rent Deferral Program] (“Program”) through this portal (“Portal”), or through other methods, including email, mail, telephone, fax or in-person.
By clicking to accept these Terms, you affirm and agree that:
– You are bound by and will comply with, and that you have the legal authority to bind your organization or company to, the Terms, which include First Capital’s website terms of use (https://fcr.ca/terms-of-use/) and Privacy Policy (https://fcr.ca/privacy-policy/);
– You will use the Portal responsibly and in compliance with all applicable laws;
– Any information or files you submit for the purposes of the Program does not violate the legal rights of any third party, does not contain unnecessary personal or sensitive information and does not contain viruses or any other malicious content;
– First Capital’s provision of the Program, Portal or related communications does not constitute an offer or a solicitation of an offer to provide funds or assistance through the Program or otherwise;
– You may not assign, novate or otherwise transfer any rights or obligations under these Terms.
You should not provide more information through the Portal than what is strictly requested for the purposes of the Program. First Capital assumes no responsibility for any information, including personal, sensitive, confidential or proprietary information, you disclose that in our sole opinion is not necessary for the purposes the Program. Our Privacy Policy governs the processing of all personal information strictly required as part of the Portal or Program. You must take appropriate measures to review, redact or edit materials you provide us to prevent any unnecessary disclosure of non-relevant information to us.
First Capital takes reasonable steps to ensure the security of its systems. However, there are inherent risks associated with the use of electronic means of communication. You acknowledge that the transmission of data via the Portal is subject to risks of human and machine errors, omissions, unauthorized accesses (such as hacking), delays, losses (including but not limited to viruses or inadvertent loss of data or damage to media) or law enforcement access that may give rise to loss or damage. First Capital will not be liable for any such errors, omissions, delays or losses, except to the extent caused by its gross negligence or willful misconduct (and subject to all other terms and conditions of these Terms). The Portal should only be used as a conduit for information, not as information storage.
